Acuerdo de Ciudad del Cabo de 2012
El Acuerdo de Ciudad del Cabo de 2012 sobre la implantación de las disposiciones del Protocolo de Torremolinos de 1993 relativo al Convenio internacional de Torremolinos para la seguridad de los buques pesqueros 1977 (el Acuerdo) fue adoptado por la Conferencia internacional sobre la seguridad de los buques pesqueros celebrada del 9 al 11 de octubre de 2012 en Ciudad del Cabo (Sudáfrica) bajo los auspicios de la Organización Marítima Internacional (OMI) como resultado de la ardua labor realizada y los intensos debates mantenidos a lo largo de cinco años.
La seguridad de los pescadores y de los buques de pesca forma parte integrante del mandato de la OMI sin embargo desde una perspectiva mundial el sector pesquero no cuenta con un historial de seguridad aceptable; y aunque varios factores han contribuido a ello no hay duda que la falta de un regimen normativo vinculante a nivel internacional ha desempeñado un papel significante en la situación actual. En este contexto ni el Convenio internacional de Torremolinos para la seguridad de los buques pesqueros 1977 ni el Protocolo de Torremolinos adoptado en 1993 llegaron a entrar en vigor debido a varias restricciones de índole técnica y jurídica. El Acuerdo supuso la renovación de las disposiciones de entrada en vigor del Protocolo de Torremolinos de 1993 y se espera que desempeñe una función importante en la mejora de las normas de seguridad y la reducción de la pérdida de vidas humanas en el sector de la pesca.
El Acuerdo de Ciudad del Cabo de 2012 entrará en vigor 12 meses después de la fecha en que por lo menos 22 Estados que tengan como mínimo 3 600 buques pesqueros de eslora igual o superior a 24 m que operen en alta mar en total hayan manifestado su consentimiento en obligarse por él.
Cape Town Agreement of 2012
The safety of fishers and fishing vessels forms an integral part of IMO’s mandate; however the fishing industry from a global perspective does not have an acceptable safety record and while there may be a number of factors that have contributed to this there can be no doubt that the lack of an effective internationally binding regulatory regime has played a significant part in the status quo. The Cape Town Agreement of 2012 was a renewed commitment for the provisions of the 1993 Torremolinos Protocol to come into force and is expected to play an important part in improving safety standards and reducing the loss of life in the fisheries sector.

《2012年开普敦协定》将在合计不少于3600艘24米及以上长度的在公海作业的渔船的不少于22个国家表示同意受本协定约束之日后12个月生效。

L’Accord du Cap de 2012 sur la mise en œuvre des dispositions du Protocole de Torremolinos de 1993 relatif à la Convention internationale de Torremolinos sur la sécurité des navires de pêche 1977 a été adopté par la Conférence internationale sur la sécurité des navires de pêche tenue du 9 au 11 octobre 2012 au Cap (Afrique du Sud) sous les auspices de l’Organisation maritime internationale (OMI) aux termes de travaux soutenus et d’un échange de vues approfondi sur une période de cinq ans.
La sécurité des pêcheurs et des navires de pêche fait partie intégrante du mandat de l’OMI; toutefois le secteur de la pêche d’un point de vue mondial ne fournit pas un bilan de sécurité acceptable et s’il est vrai qu’un bon nombre de facteurs y ont contribué il ne fait aucun doute que l’absence d’un régime réglementaire international efficace et obligatoire a joué un rôle non négligeable pour préserver le statu quo. Dans ce contexte ni la Convention internationale de Torremolinos sur la sécurité des navires de pêche adoptée en 1977 ni le Protocole de Torremolinos adopté en 1993 ne sont entrés en vigueur en raison de diverses contraintes d’ordre juridique et technique. L’Accord marquait un engagement renouvelé en faveur de l’entrée en vigueur des dispositions du Protocole de Torremolinos de 1993 et il devrait jouer un rôle majeur dans l’amélioration des normes de sécurité et la réduction des pertes en vies humaines dans le secteur halieutique.
L’Accord du Cap de 2012 entrera en vigueur 12 mois après la date à laquelle le consentement à être lié par lui aura été exprimé par au moins 22 États dont le nombre total de navires de pêche d’une longueur égale ou supérieure à 24 m exploités en haute mer est au moins égal à 3 600.

Результат упорной работы и интенсивных обсуждений в течение пятилетнего периода Кейптаунское соглашение 2012 года об осуществлении положений Торремолиносского протокола 1993 года к Торремолиносской международной конвенции по безопасности рыболовных судов 1977 года (Соглашение) было принято Международной конференцией по безопасности рыболовных судов которая состоялась 9-11 октября 2012 года в Кейптауне Южная Африка под эгидой Международной морской организации (ИМО).
Безопасность рыбаков и рыболовных судов составляет неотъемлемую часть компетенции ИМО однако для рыболовной отрасли в глобальной перспективе не отмечены приемлемые показатели безопасности и хотя свою роль в этом сыграли множество факторов не остается сомнений в том что на существующее положение дел серьезное влияние оказал факт отсутствия эффективного международного режима регулирования обязательного характера. В этом контексте необходимо отметить что вследствие ряда затруднений технического и юридического характера ни Торремолиносская международная конвенция по безопасности рыболовных судов принятая в 1977 году ни Торремолиносский протокол 1993 года не вступили в силу. Соглашение представляет собой возобновленное обязательство о введении в действие положений Торремолиносского протокола 1993 года оно должно сыграть важную роль в повышении стандартов безопасности и снижении количества случаев гибели в рыболовном секторе.
Кейптаунское соглашение 2012 года вступит в силу через 12 месяцев после даты в которую не менее 22 государств рыболовный флот которых в совокупности составляет не менее 3600 судов длиной 24 м и более эксплуатирующихся в открытом море выразят свое согласие на его обязательность для них.

اعتُمِدَ اتفاق كيب تاون لعام 2012 بشأن تتفيذ أحكام بروتوكول توريمولينوس لعام 1993 المتعلق باتفاقية توريمولينوس الدولية لسلامة سفن الصيد لعام 1977 (الاتفاق) من قِبل المؤتمر الدولي بشأن سلامة سفن الصيد ، الذي عُقِدَ في الفترة من 9 إلى 11 تشرين الأول/أكتوبر 2012 ، في كيب تاون ، جنوب أفريقيا ، برعاية المنظمة البحرية الدولية (IMO) ، نتيجةَ عمل شاق ومناقشات مكثفة على مدى خمس سنوات .
وتشكّل سلامة الصيادين وسخن الصيد جزءاً لا يتجزأ من المهام الموكلة إلى المنظمة البحرية الدولية ؛ وعلى أي حال ، فإن قطاع صيد الأسماك لا يمتلك ، من منظور عالمي ، سجلاً مقبولاً للسلامة · وفي حين أنه قد يكون هناك عدد من العوامل اٍلتي أسهمت في ذلك ، ليس هناك أدنى شك في أن عدم وجود نظام قانوني ملزم دولياً قد لعب دورا كبيراً في الوضع الراهن . وفي هذا السياق ، لم تدخل اتفاقية توريمولينوس الدولية لسلامة سفن الصيد ، التي اعتُمِدَت في عام 1977 ، و لا بروتوكول توريمولينوس ، الذي اعتُمِدَ في عام 1993 ، حيّز التنفيذ نظراً لمجموعة متنوعة من القيود التقنية والقانونية . وما هذا الاتفاق سوى التزام متجدد بأن تدخل أحكام بروتوكول توريمولينوس لعام 1993 حيّز التنفيذ ، ومن المتوقع أن يقوم بدور هام في تحسين معايير السلامة والحد من الخسائر في الأرواح في قطاع صيد الأسماك .
ويسري مفعول اتفاق كيب تاون ن لعام 2012 بعد انقضاء 12 شهراً على تاريخ قيام ما لا يقل عن 22 دولة من الدول التي لا يقلّ مجموع عدد ما لديها من سفن صيد يبلغ طولها 24 متراً فأكثر وتعمل في أعالي البحار عن 3600 سفينة بالإعراب عن مو افقتها على الالتزام به .
Orientations de 2012 pour l’établissement de listes d’intervention et de niveaux d’intervention pour les déchets de poisson
La présente publication contient des orientations à l’intention des autorités chargées de la réglementation et des responsables de l’élaboration de politiques au sujet de l’établissement de listes d’intervention et de la mise au point de niveaux d’intervention applicables aux déchets de poisson qu’il est envisagé d’évacuer en mer. Tout en étant destinées à aider à mettre en œuvre les prescriptions de la Convention de 1972 sur la prévention de la pollution des mers résultant de l’immersion de déchets (Convention de Londres) et de son Protocole de 1996 (Protocole de Londres) les orientations ont une portée générale et pourraient être appliquées à l’évaluation des déchets de poisson prévue par d’autres instruments.
2012 Guidelines for the Development of Action Lists and Action Levels for Fish Waste
This publication provides guidance to regulators and policy makers on the selection of action lists and the development of action levels for fish waste proposed for disposal at sea. While the Guidance is designed to assist with implementation of requirements under the Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter 1972 (London Convention) and its 1996 Protocol (London Protocol) the Guidance is general and could be applied to the assessment of fish waste under other instruments.

It covers the requirements of the STCW-F and IMO/FAO/ILO Document for Guidance on Training and Certification of Fishing Vessel Personnel chapter 6.24 and 6.29 and is open to all fishing vessel personnel who are to serve on board sea-going Fishing vessels. There are no particular educational entry requirements.

Recueil de Règles de Sécurité pour les Pêcheurs et Les Navires de Pêche
Le Recueil révisé a été approuvé par le Comité de la sécurité maritime (MSC) à sa soixante-dix-neuvième session en 2004 par le Comité des pêches de la FAO à sa vingt-sixième session en 2005 et par le Conseil d'administration du BIT à sa 293ème session en 2005. Il est divisé en deux parties (vendues séparément) :

Safety of Fishing Operations (Support Level)
This model course is for candidates who will undertake fishing operations on board ship in accordance with chapter III regulation 1.6 and attachment 2 resolution 4 annex 2.2 of STCW-F. It covers the requirements of the STCW-F and IMO/FAO/ILO Document for Guidance on Training and Certification of Fishing Vessel Personnel chapter 6.24 and 6.29 and is open to all fishing vessel personnel who are to serve on board sea-going Fishing vessels. There are no particular educational entry requirements.
Document FAO/OIT/OMI Destiné à Servir de Guide pour la Formation du Personnel des Navires de Pêche et la Délivrance des Brevets
Le premier guide international de formation maritime à l'intention des pêcheurs intitulé Document destiné à servir de guide pour la formation des pêcheurs et la délivrance des brevets avait été établi par un groupe de travail mixte (Organisation des Nations Unies pour l'alimentation et l'agriculture (FAO)/Organisation internationale du Travail (OIT)/Organisation maritime internationale (OMI)) et avait été publié par l'OMI en 1985.
Le Document destiné à servir de guide tenait compte des conventions et des recommandations adoptées par l'OIT et l'OMI et de la vaste expérience acquise par la FAO dans le domaine de la formation des pêcheurs; il couvrait la formation des pêcheurs se livrant à la pêche artisanale et industrielle et la délivrance des brevets.
En 1995 le Groupe de travail mixte en coopération avec la FAO et l'OIT a révisé le Document destiné à servir de guide en tenant compte des résolutions issues de la Conférence internationale de 1995 sur les normes de formation du personnel des navires de pêche de délivrance des brevets et de veille (Conférence STCW-F). Les travaux du Groupe de travail mixte ont permis d'établir le texte révisé du document intitulé Document destiné à servir de guide pour la formation du personnel des navires de pêche et la délivrance des brevets.

The first international maritime training guide for fishermen the Document for Guidance on Fishermen’s Training and Certification was prepared by a joint FAO/ILO/IMO working group and published by IMO in 1985.
The Document for Guidance took account of the conventions and recommendations adopted by ILO and IMO and the wide practical experience of FAO in the field of fishermen’s training; it covered training and certification of small-scale and industrial fishermen.
In 1995 a joint working group in co operation with FAO and ILO reviewed the Document for Guidance with particular reference to relevant resolutions of the 1995 International Conference on Standards of Training Certification and Watchkeeping for Fishing Vessel Personnel (STCW-F). The outcome was a revised document entitled Document for Guidance on Training and Certification of Fishing Vessel Personnel.
